١- النية باخلاص امره لله وان لا يقصد به الدنيا. ٢- علم وحلم ووقار و سكينة فالحلم زينة العلم كما يقال. ٣- قويا على ماهو فيه، اي ان يكون المفتي متضلعا بالعلم غير ضعيف فيه فلا يحجم عن الحق فيظهره الله على لسانه. ٤- الكفاية، أي ان يكون له مصدر رزق ليتعفف عن الناس كي لا يستعمل الناس عليه سلطتهم او يجلبون منه فتاوى. تناسبهم ٥- أن تكون له معرفة بالناس وهذه من الفراسة فيتفرس في الناس فيعطي كلا بحسب حاله.
